Termination of civil servant status / retirement
Temporary civil servant status
Temporary civil servant contracts end automatically due to the expiry of the term unless an extension is granted on the basis of statutory provisions (NRW Higher Education Act, NRW State Civil Servants Act) on application in good time before the expiry of the temporary civil servant contract.
Dismissal by law and by administrative act
If a new employment or official relationship under public law is established with another employer, the civil servant is generally dismissed by operation of law in accordance with Section 22 BeamtStG with the previous employer.
Termination can also be effected by dismissal at your own request in accordance with § 27 LBG NRW if you intend to take up employment in the private sector or abroad. In this case, an application for dismissal from your civil servant status must be submitted in good time (at least 4 weeks before taking up the new position) to the Personnel Department via the official channels.
In any case, please inform your personnel officer immediately if you intend to establish a new official or service relationship under public law or take up a new position in the private sector or abroad.
Entry or transfer into retirement
The active civil servant relationship generally ends when the civil servant reaches the relevant age limit in accordance with Section 25 of the Civil Servants Status Act (BeamtStG) and Section 31 of the NRW State Civil Servants Act (LBG NRW).
The civil servant relationship can also be terminated by retirement at the employee's own request if the requirements are met (Section 33 LBG NRW).
If you have any questions relating to the termination of your civil servant status, please contact your HR officer directly.
